The former owner of a Burnaby, B.C., pub has been handed a nine-month conditional sentence after pleading guilty to sexual assault in a case that prompted criticism of the police from the convicted man’s lawyer.
Fernando Manuel Alves, 46, had faced four charges of sexual assault and one charge of administering a noxious substance.
His arrest two years ago prompted police to warn the public about drink-spiking.
Alves ultimately pleaded guilty to one count of sexual assault after the other assault charges and the administering charge were dismissed following a preliminary hearing.
His lawyer, Lawrence Myers, maintains that Alves couldn’t possibly be the kind of man police have made him out to be,
(write your own caption), which might prompt one to wonder exactly what kind of man he thinks routinely drugs and rapes women… just a “regular guy”? Why not? With Myers’ client list, Alves probably is a pretty regular guy. But that’s to be expected when your business is criminal law. However, the sleaze shouldn’t extend to the judge, who callously dismissed the assaults as a “crime of opportunity” and allowed the creep to walk without a day of time. Does that make sense? (Or cents? Or maybe $en$e?)
It would be interesting to know who the judge was, and what other cases he’s presided over. Dr. Dawg is on it: this ain’t over.

10 bucks says that the asshole doesn’t even think what he did is rape. He probably has all sorts of euphemisms he uses to justify himself as not a rapist. He was just “taking advantage of the situation” or some such rot.
His lawyer told him to express remorse at the time of the sentencing; apparently it seemed authentic enough to convince the judge or at least the pretense of it did.
RQ – I wouldn’t be surprised if you were right. It’s a measure of the misogyny that still exists in our society that if a woman is lying there conked out and not resisting (even if she was slipped a roofie to get her that way), that means she’s fair game for whatever.
I’ve seen it way too often, men who are unequivocally rapists (they locked their daughter or other women in basements for years, etc) claim that they were having consensual sex. I think their rule is that as long they have said hello to the woman once, they are no longer a rapists. The woman doesn’t even have to be conscious when they say it.
deBeauxOs – Since it appears that he’s been doing this routine for awhile, his remorse is highly suspect. I doubt if that alone would have swayed the judge.
oh my oh dear, the soft west coast strikes again. the courts here are beyond lenient. both male and female judges kowtow to criminal rights. i can tell you one hell of a horror story about a friend’s underage daughter and the paroled older ‘boyfriend’ who beat her, drugged her, let his friends gang-bang her. he threatened the girl and her mother.

It’s a male entitlement thing. Entitlement to take what he wants because he wants it and as in the case of the guy who threatened and acted out violence toward Scout’s loved ones, to express himself violently as he feels like doing.

Unfortunately that seems to be the way the system “works” — defense lawyers are in the business of defending their clients, not seeing that justice is done. Their job is to find the shadow of doubt that lets their client off the hook.
Not right, but that’s how it is. A defense lawyer’s biggest selling feature is his/her ability to find the loopholes in the case and walk their clients through them.
JAB – I recognized the lawyer’s address as soon as I saw it. I know some of the lawyers in that same building (my ex retained one of them at one time) — it’s like a little criminal law cartel down there, and they’re really really good at what they do.

orange – I don’t think it’s a “male” entitlement thing as much as a “neanderthal male” entitlement thing. Most men would be disgusted rather than turned on by this kind of abuse.
That said, there’s definitely a minority of men with *problems* who would see this as a viable way to get sex without too much hassle. These are the guys who view women primarily as receptacles to start with, so it wouldn’t be too huge a leap for them to figure it would be okay to drug someone who wasn’t co-operating.

I am not referring to every individual man when I speak about male entitlement. Of course lots of individual men wouldn’t act either as this rapist or this judge did. But any individual man may, if he chooses, act in certain ways and stand a good chance of getting away with it because of the entitlement he has as a male person in our culture.
I have often noticed that many men who would not behave this way themselves do not call other men on it when they do behave that way. And that too many of the men who speak up in general against violence against women avoid getting involved when another man is actually abusing a woman and even their mere presence on the scene could be enough to disrupt it, let alone their taking a more active measure. Thank god many men will step up but too many still won’t. I think there are complicated reasons for this. But at least one — and only one — is that many men don’t want to appear unmanly to other men.
I am being sociological, but I don’t mean by this that I am being academic. I naturally think in ways that are sociological, which means that I am always looking for the systems in which individuals are located in order to better understand their behaviour.

One of the lawyers in the same building does a lot of work for bikers (which is how I know him), but he was also Clifford Olson’s lawyer for awhile 😯 He quit though, couldn’t take the pressure. Yes the cops have it. Just thought anyone who lives in his neighborhood would want to know where the convicted sex offender lives. Also, police were asking for MORE INFORMATION about him back when they originally found 4 victims. Why would they think there were more? Perhaps there was evidence of more victims, but they were unidentified – perhaps faces weren’t shown in photos, perhaps he kept souvenirs… I wonder how many women were his victims who DIDN’T report it – sorry – but this case really has me worked up. Did you know the two officers who finally investigated him (and who found the 4 victims) actually appeared at the sentencing? It was that important to them. I feel bad that all their hard work got lost in the legal quagmire.

I have been one of Fernando’s friends who has attended big group parties at his lodge in Whistler. I have found him to be charming and fun and had no idea he was capable of this.
