Crimes of opportunity

Attention ladies:  don’t let this fat little beady-eyed fuck   DAMMIT JANET!_1250734127921

buy you a drink.  Not even a coffee.  If you see his smirking visage nearby, run.

The asshole in the picture, Fernando Manuel Alves, has a right to smirk:  he beat the system:

The former owner of a Burnaby, B.C., pub has been handed a nine-month conditional sentence after pleading guilty to sexual assault in a case that prompted criticism of the police from the convicted man’s lawyer.

Fernando Manuel Alves, 46, had faced four charges of sexual assault and one charge of administering a noxious substance.

His arrest two years ago prompted police to warn the public about drink-spiking.

Alves ultimately pleaded guilty to one count of sexual assault after the other assault charges and the administering charge were dismissed following a preliminary hearing.

His lawyer, Lawrence Myers, maintains that Alves couldn’t possibly be the kind of man police have made him out to be,

myers

(write your own caption), which might prompt one to wonder exactly what kind of man he thinks routinely drugs and rapes women… just a “regular guy”?  Why not?  With Myers’ client list, Alves probably is a pretty regular guy.  But that’s to be expected when your business is criminal law.  However, the sleaze shouldn’t extend to the judge, who callously dismissed the assaults as a “crime of opportunity” and allowed the creep to walk without a day of time.   Does that make sense?  (Or cents?  Or maybe $en$e?)

It would be interesting to know who the judge was, and what other cases he’s presided over.  Dr. Dawg is on it:  this ain’t over.

UPDATE: Details from the victim’s best friend; original post from 2007 here, reaction to verdict here.

10 bucks says that the asshole doesn’t even think what he did is rape. He probably has all sorts of euphemisms he uses to justify himself as not a rapist. He was just “taking advantage of the situation” or some such rot.

  2. 2 deBeauxOs Thursday, August 20, 2009 at 11:25 am

His lawyer told him to express remorse at the time of the sentencing; apparently it seemed authentic enough to convince the judge or at least the pretense of it did.

  3. 3 JJ Thursday, August 20, 2009 at 11:29 am

RQ – I wouldn’t be surprised if you were right. It’s a measure of the misogyny that still exists in our society that if a woman is lying there conked out and not resisting (even if she was slipped a roofie to get her that way), that means she’s fair game for whatever.

  4. 4 Red Queen Thursday, August 20, 2009 at 11:34 am

I’ve seen it way too often, men who are unequivocally rapists (they locked their daughter or other women in basements for years, etc) claim that they were having consensual sex. I think their rule is that as long they have said hello to the woman once, they are no longer a rapists. The woman doesn’t even have to be conscious when they say it.

  5. 5 JJ Thursday, August 20, 2009 at 11:40 am

deBeauxOs – Since it appears that he’s been doing this routine for awhile, his remorse is highly suspect. I doubt if that alone would have swayed the judge.

  6. 6 harpervalley Thursday, August 20, 2009 at 11:48 am

oh my oh dear, the soft west coast strikes again. the courts here are beyond lenient. both male and female judges kowtow to criminal rights. i can tell you one hell of a horror story about a friend’s underage daughter and the paroled older ‘boyfriend’ who beat her, drugged her, let his friends gang-bang her. he threatened the girl and her mother.

what did the cops say about a restraining order? nada. FUCK ALL….they talked about the rights of a criminal!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

and what i went through in court with my neighbour who threatened me, killed my dog and our daughter’s cat, endlessly harrassed us? A FUCKING SLAP ON THE FUCKING WRIST!

the second time taking the bastard to court? a retiring judge who told us stories of when he was younger, and complimented our perpetrator on being a good family man. FUCK!!!!!!! (GREAT FAMILY GUY, COPS WERE ALWAYS THERE FOR DOMESTICS)

the marshmellow court and police system has to get it’s shit together. it wasn’t until the 80’s a man could be charged for beating his wife. how sick is that?

  7. 7 J. A. Baker Thursday, August 20, 2009 at 11:50 am

JJ, perhaps you should add an “abortion of justice” tag to this post.

This sicko needs to go in a hole for a very, very, very long time, trading cigarettes for his anal virginity.

Same for this sexist fuckwit who calls himself a judge.

  8. 8 J. A. Baker Thursday, August 20, 2009 at 12:02 pm

Also, is it just me, or does this Lawrence Myers asshat who goes around falsely calling himself a “lawyer” look like a demented John Ensign?

  9. 9 mouthyorange Thursday, August 20, 2009 at 1:14 pm

It’s a male entitlement thing. Entitlement to take what he wants because he wants it and as in the case of the guy who threatened and acted out violence toward Scout’s loved ones, to express himself violently as he feels like doing.

Our culture supports a lot of this still.

  10. 10 Dr. Prole Thursday, August 20, 2009 at 5:57 pm

Maybe Alves will get something slipped in his drink some time – like strychnine. Hey, it was a crime of opportunity!

  11. 11 JJ Thursday, August 20, 2009 at 6:27 pm

    RQ

The woman doesn’t even have to be conscious when they say it.

That’s one of the creepiest things about this kind of attack — the woman would have to be about comatose. Isn’t that a little like necrophilia? Eww.

  12. 12 deBeauxOs Thursday, August 20, 2009 at 6:31 pm

What creeps me out is that someone with the same name is operating a B&B lodge in Whistler. I shudder to think of women staying there if it’s the same guy.

  13. 13 JJ Thursday, August 20, 2009 at 6:33 pm

scout – Yes, I vaguely remember when all that happened — how horrible! And to think there’s really nothing you can do.

Unfortunately that seems to be the way the system “works” — defense lawyers are in the business of defending their clients, not seeing that justice is done. Their job is to find the shadow of doubt that lets their client off the hook.

Not right, but that’s how it is. A defense lawyer’s biggest selling feature is his/her ability to find the loopholes in the case and walk their clients through them.

  14. 14 JJ Thursday, August 20, 2009 at 6:47 pm

JAB – I recognized the lawyer’s address as soon as I saw it. I know some of the lawyers in that same building (my ex retained one of them at one time) — it’s like a little criminal law cartel down there, and they’re really really good at what they do.

  15. 15 JJ Thursday, August 20, 2009 at 6:47 pm

JAB – OMG, he does!!! 😆

  16. 16 JJ Thursday, August 20, 2009 at 7:09 pm

orange – I don’t think it’s a “male” entitlement thing as much as a “neanderthal male” entitlement thing. Most men would be disgusted rather than turned on by this kind of abuse.

That said, there’s definitely a minority of men with *problems* who would see this as a viable way to get sex without too much hassle. These are the guys who view women primarily as receptacles to start with, so it wouldn’t be too huge a leap for them to figure it would be okay to drug someone who wasn’t co-operating.

    Ew.

  17. 17 JJ Thursday, August 20, 2009 at 7:11 pm

Dr.Prole – Haha, you never know when those crimes of opportunity will present themselves. If I was the woman he attacked, after getting diddly out of the courts I can’t say I wouldn’t be thinking about it.

  18. 18 JJ Thursday, August 20, 2009 at 7:13 pm

deBeauxOs – {{{shudder}}} If it’s the same guy, there must be a whole bunch of former customers who are breathing a sigh of relief that they dodged a bullet.

  19. 19 Dr.Dawg Friday, August 21, 2009 at 9:53 am

It’s the same guy. Remember he used to own a pub?

  20. 20 Dr.Dawg Friday, August 21, 2009 at 11:24 am

Lemme double-check this before anyone does anything.

  21. 21 JJ Friday, August 21, 2009 at 1:05 pm

Dr.Dawg – Heh – I couldn’t help noticing his education: am I reading it wrong or did he take 9 years to get a BA in communications? That’s about a 4 or 5 semester course, isn’t it? Unless it was some kind of “continuing studies” deal, maybe by correspondence, perhaps at one of our fine correctional institutions.

Yep, it’s probably the same guy.

  22. 22 mouthyorange Saturday, August 22, 2009 at 2:27 am

I am not referring to every individual man when I speak about male entitlement. Of course lots of individual men wouldn’t act either as this rapist or this judge did. But any individual man may, if he chooses, act in certain ways and stand a good chance of getting away with it because of the entitlement he has as a male person in our culture.

I have often noticed that many men who would not behave this way themselves do not call other men on it when they do behave that way. And that too many of the men who speak up in general against violence against women avoid getting involved when another man is actually abusing a woman and even their mere presence on the scene could be enough to disrupt it, let alone their taking a more active measure. Thank god many men will step up but too many still won’t. I think there are complicated reasons for this. But at least one — and only one — is that many men don’t want to appear unmanly to other men.

I am being sociological, but I don’t mean by this that I am being academic. I naturally think in ways that are sociological, which means that I am always looking for the systems in which individuals are located in order to better understand their behaviour.

  23. 23 Frank Frink Monday, August 24, 2009 at 7:04 pm

The LinkedIn profile/info? Yes, it’s the same guy. Station Square was the pub he owned.

  24. 24 JJ Tuesday, August 25, 2009 at 7:10 am

orange – OK, I get you. Agreed, it’s a evolutionary long process.

  25. 25 JJ Tuesday, August 25, 2009 at 7:14 am

FF – This guy’s lawyer… are you familiar with any of those lawyers that work at 195 Alexander? Just wondering

  26. 26 Frank Frink Tuesday, August 25, 2009 at 6:36 pm

Sorry, JJ. Not familiar with his lawyer or the folks down @ 195 Alexander.

  27. 27 Frank Frink Tuesday, August 25, 2009 at 6:42 pm

Ooops, one more high-profile BC case where Myers served as defence lawyer. You might find this one an interesting reminder.

  28. 28 JJ Tuesday, August 25, 2009 at 9:17 pm

FF – Oh no! He really takes on the sleaziest clients, doesn’t he?

One of the lawyers in the same building does a lot of work for bikers (which is how I know him), but he was also Clifford Olson’s lawyer for awhile 😯 He quit though, couldn’t take the pressure. But that’s where reputations are made in criminal law, by taking on the scum of the earth as clients. Ugh. No wonder so many of these guys are drunks & druggies.

  29. 29 Dangerous Thursday, August 27, 2009 at 10:23 am

Google BC Ball Hockey Association… look – alves is tournament director. And the WBHL – western ball hockey league, has links to the Raiders Pre-Season Tournament – please send your money to Fernando Alves… oh look, his email address… and his phone number, and his street address?? My goodness, how easy it is to track down convicted sexual offenders…

  30. 30 Dangerous Thursday, August 27, 2009 at 10:26 am

And who’s to say former customers of his at Lorimer lodge in Whistler DID manage to dodge a bullet. At least one woman in whistler accused him… and that was one of the charges he faced.
Why doesn’t someone post his face around Seattle and other places, as chances are his victims were from all over the place.

  31. 31 Dangerous Thursday, August 27, 2009 at 10:31 am

    http://lorimerridge.com/tour_of_the_lodge.htm

oh look, “bridal showers welcome”… how nice. Wonder if any of them fell victim to him…

  32. 32 JJ Thursday, August 27, 2009 at 11:15 am

Dangerous – I’m not sure what you’re getting at — if the info is that easy to find, the cops already have it.

  33. 33 Dangerous Thursday, August 27, 2009 at 2:51 pm

Yes the cops have it. Just thought anyone who lives in his neighborhood would want to know where the convicted sex offender lives. Also, police were asking for MORE INFORMATION about him back when they originally found 4 victims. Why would they think there were more? Perhaps there was evidence of more victims, but they were unidentified – perhaps faces weren’t shown in photos, perhaps he kept souvenirs… I wonder how many women were his victims who DIDN’T report it – sorry – but this case really has me worked up. As far as I know, his face was on Vancouver papers, but not in Seattle (where a lot of people come to visit from). I’m just so incensed by the whole thing – and am working on my letter to
    Mr. Grant B. Wong
    Deputy Regional Crown Counsel
    222 Main Street
    Vancouver, B.C.
    V6A 2S8
Someone should get the court transcripts and hear just how sleazy this guy is…
Did you know the two officers who finally investigated him (and who found the 4 victims) actually appeared at the sentencing? It was that important to them. I feel bad that all their hard work got lost in the legal quagmire.

I have just found out that the name of the pub is The Vault Pub and Grill, owned by Tony Lecce, who had run it as a strip club.

I have been one of Fernando’s friends who has attended big group parties at his lodge in Whistler. I have found him to be charming and fun and had no idea he was capable of this. I recently heard about a woman who reportedly woke up next to Fernando with no memory of the night before only last year. I am shocked. He is highly liked by many women. He provides a lot of alcohol for free at group events that he hosts. Thank you for the warning.
